Tree Health and Safety Pty Ltd are an owner/operator business and is led by an experienced and qualified arborist who has successfully completed AHC50520- Diploma of Arboriculture (AQF5 Arborist)and Tree Risk Assessment Qualification (TRAQ).
All work undertaken by Tree Health and Safety Pty Ltd is led by our owner/operator and supported by professional team members.
2. Estimates and Quotes
- All estimates are provided based on initial evaluations and may vary upon further inspection.
- Written quotes are valid for 14 days.
3. Payment Terms
- Payment is due immediately upon completion of works, unless otherwise agreed in writing prior to commencement.
- If tree work takes more than a day, part payment may be charged at the end of each working day until the job is completed.
- Accepted payment methods include bank transfer or card payment via Stripe. Card payments may incur a surcharge in accordance with Stripe’s current fees. Please quote the invoice number when making payment by bank transfer.
- Overdue accounts may incur reasonable administration or recovery costs in accordance with Australian Consumer Law.
- Alternative payment arrangements must be agreed to prior to commencement of works.
- By engaging our services, you consent to receiving invoices, payment reminders, and job-related communications by SMS, email, or phone.
4. Client Responsibilities
- The client is responsible for ensuring that any tree pruning, or removal completed has the correct consent from the owner of the land.
- Clients must ensure that the work area is clear of obstacles and that any necessary permits are obtained prior to service.
- It is the client’s responsibility to inform us of any hazards on the property, including but not limited to underground utilities.
- Ensure that all pets are securely contained, please clean up any pet mess around work area prior to commencement, this is a Health and Safety issue.
5. Permits, Reports and Approvals
- Where required, it is the client’s responsibility to obtain any necessary council approvals, permits, or authorisations prior to works commencing, unless otherwise agreed in writing.
- Tree Health and Safety Pty Ltd can prepare arborist reports or assessments to support permit applications where requested, as inspections and assessments are undertaken by a Certificate V (AQF5) qualified arborist.
- Tree Health and Safety Pty Ltd does not guarantee the outcome of any permit or approval process and is not responsible for delays, cancellations, or costs arising from approvals not being obtained prior to the scheduled work date.
- Use of Arborist Reports:
Any arborist reports, assessments, or written advice prepared by Tree Health and Safety Pty Ltd are provided solely for the purpose of supporting permit applications, general tree management, or client decision-making at the time of inspection. Reports are based on visual assessment and information available at the time.
- Such reports are not prepared for use in legal proceedings, expert witness testimony, or court matters, unless expressly agreed in writing. Tree Health and Safety Pty Ltd does not consent to the use of its reports for any other purpose, nor to their reliance by third parties, without prior written approval.
6. Cancellation and Rescheduling
- Cancellations made within 24 hours of the scheduled start time may incur a reasonable cancellation fee to cover allocated labour, equipment, and lost scheduling costs.
- We reserve the right to reschedule work due to inclement weather or other unforeseen circumstances. NOTE: Emergency call outs may take priority over scheduled work.
7. Tree Removal
- We will complete the removal of any tree as close to ground level as possible and remove all debris (unless otherwise stated)
- Requests for Firewood must be organised prior to day of works, The term “Timber cut to firewood size” refers to logs being cut into blocks approx. 300-400mm, or manageable lengths suitable for splitting but not including splitting unless specified. The term “wood remains on-site” refers to the blocks of cut wood being left in a convenient location but not moved elsewhere or stacked unless specified.
8. Tree Pruning
- All pruning is carried out in accordance with AS 4373-2007 (Pruning of Amenity Trees). Where site conditions require, a qualified AQF5 arborist may apply professional judgement consistent with industry standards.
9. Stump Grinding/Poisoning
- Stump grinding is an additional cost.
- All wood debris and soil mix remain on site after a stump is ground.
- Please note that stump grinding work can sometimes be completed on the same day as tree removal. However, there are occasions when we may need to reschedule for a second visit to conduct the stump grinding.
- Stump poisoning is a technique that involves applying an herbicide or stump killer to the freshly cut surface of the stump to prevent regrowth.
10. Tree Bracing
- Bracing of trees is intended to reduce the hazard potential only. It does not permanently remedy structural weakness and does not guarantee against failure.
- Braced trees require periodic inspections. Unless otherwise agreed, Tree Health and Safety Pty Ltd are not responsible for ongoing inspections following installation.
11. Cleanup
- Clean-up to include removal of logs, branches, leaves, and twigs.
- The work area will be raked but some excess saw dust, leaves, branches, or twigs may remain.
- Mulch can be left on premises if requested prior by client.
12. Lawn & Surfaces Damage
- Clients acknowledge that during the provision of services, there is a possibility of damage to lawns, landscaping, or other surfaces.
- While all reasonable care is taken, clients acknowledge that tree works involve heavy equipment and access requirements that may result in unavoidable impact to lawns, gardens, or surfaces. Tree Health and Safety Pty Ltd are not responsible for damage that is inherent to the nature of the works, provided reasonable care has been exercised.
13. Additional work requests
- Any additional work requested by the client that is not in the original quote will be done at the discretion of our team on the day.
- Due to other bookings or time constraints some requests may need to be rebooked for another day.
- Any extra work approved will be listed on your updated invoice as “Extra work.”
14. Liability and Insurance
- Tree Health and Safety Pty Ltd carries current public liability insurance and workers compensation cover. Relevant documentation is available on request.
- To the extent permitted by law, Tree Health and Safety Pty Ltd is not liable for loss or damage arising from factors beyond our control.
- Nothing in these terms excludes, restricts, or modifies any rights or guarantees under Australian Consumer Law.
- Clients are responsible for damages to property or injuries to persons not directly caused by the negligence of Tree Health and Safety Pty Ltd.
15. Safety and Compliance
- All work will be performed in accordance with industry safety standards and regulations.
- We prioritize safety and reserve the right to halt work if we deem conditions unsafe.
16. Dispute Resolution
- In the event of a dispute, both parties agree to attempt resolution through mediation prior to pursuing legal action.
17. Changes to Terms
- We reserve the right to modify these terms and conditions at any time. Clients will be notified of significant changes via email or on our website.
18. Disclosure Statement
- Arborists cannot detect or anticipate every condition or event that could possibly lead to the structural failure of a tree, or guarantee that a tree will be healthy or safe under all circumstances. Trees can be managed but not controlled.
